I’m having trouble believing that there’s even a debate about whether the President of the United States, any President of the United States, has the Constitutional authority to order the assassination by drone of an American citizen on US soil who poses no imminent national security threat without first providing that citizen due process in a court of law.

Yet here we are, in a place where a Republican Senator can filibuster the nomination of a potential CIA director for nearly 13 hours unsuccessfully trying to get the White House to answer that basic question, a place where the Democrats running the US Senate strike down a resolution saying nothing more than that the Senate is against these assassinations.

Attorney General Eric Holder believes the White House has this authority. Republican Senator Rand Paul spoke for nearly 13 hours yesterday and this morning trying to get the White House clarify under what conditions it would use this tactic. Many Republican Senators, even some who had dined with the President earlier in the evening, stood with Paul in demanding answers.

Pennsylvania’s own Pat Toomey was one Senator who provided support to Paul throughout the day.  Texas Senator Ted Cruz and Florida Senator Marco Rubio were two others. Even Illinois Senator Mark Kirk, who is barely mobile while recovering from a stroke, limped onto the Senate floor to provide Paul with food and a beverage.  Late in the evening, Minority Leader Mitch McConnell and others finally fell in to stand with Senator Paul.

But there were dozens of other Republican Senators who were nowhere to be found. They either don’t care about the President asserting that he has the authority to assassinate US citizens on US soil without due process or they agree with him.  We deserve to know which it is.

As a side note, I am especially disappointed in newly minted Establishment Republican Kelly Ayotte, who ran for office as a completely different kind of Republican than she has turned out to be, and not just around the edges but at her core.
